Strong Mark vs Weak Mark

Trademark protection is based on a strength of the name and colours. Distinctive trademarks are strong and protectable. Trademarks that are not distinctive or unique are weak and cannot be registered or protected unless the trademark owners create awareness among the consumer.

Weak marks are named directly to the goods and services or ingredient. Many business owners prefer to use weak marks because they think descriptive mark provides information of the product or service they provide.

But Weak marks can also be distinguished by extensive brand awareness, sales and advertising. The general public over the period of time relate and associate it with particular source and colour combination.
